Earthrise Legal Fellow’s first “live” court appearance

Our senior legal fellow, Haley Nicholson ’22, made her first live court appearance in federal district court in Maine to argue for more transparency in government decision-making. She presented oral argument in a case in which Earthrise represents several public interest environmental organizations opposing an electrical transmission line cutting across fragile and ecologically important habitat in western Maine.

At the end of November 2022, Earthrise had a big win when we obtained a preliminary injunction in our lawsuit on behalf of Sea Shepherd New Zealand and Sea Shepherd Conservation Society seeking to protect the Māui dolphin, a critically endangered dolphin found only in waters around New Zealand’s North Island.

Saving Southern Sea Otters

Earthrise recently assisted Environment America, Environment Oregon, and Environment California in drafting and submitting comments to U.S. Fish and Wildlife Service asking the Service to make a negative determination on a petition to delist the Southern sea otter from the Endangered Species Act.

Earthrise Alum Jesse Buss Makes Our Arguments to Save Walton Lake’s Old Growth Forest Before the Ninth Circuit

On March 30th Jesse Buss (2012 Earthrise alum) presented oral argument before the Ninth Circuit in Seattle, urging the court to leave in place an injunction preventing the Forest Service from logging hundreds of old-growth firs surrounding the popular Walton Lake area in Oregon’s Ochoco National Forest. Jesse’s co-counsel Earthrise Clinical Professor Tom Buchele and Bridgett Chevallier (2020 Earthrise alum and former legal fellow) were at counsel’s table for the argument.

Working to Protect the California Condor

Last Thursday, Earthrise legal fellow Alex Houston appeared before the Ninth Circuit to argue the third appeal in our long-running case on behalf of the Center for Biological Diversity, Sierra Club, and Grand Canyon Wildlands Council (Wild Arizona) to protect California condors and other wildlife from poisoning due to consumption of spent lead ammunition disposed of on the Kaibab National Forest in Arizona. Alex did a great job – now, we wait!

Earthrise is working to make sure EPA holds water polluters accountable

On behalf of Food & Water Watch, Earthrise is suing EPA over their woefully outdated and inadequate pollution standards. Despite a statutory requirement to review guidelines every year, EPA has refused to update standards for Concentrated Animal Feeding Operations (CAFO) for years. If we are successful in this case, EPA will have to reconsider CAFO pollution limits and may finally enforce real standards on these polluters. Earthrise Secures Favorable Ruling to Protect Rogue River Water Quality

Earthrise, on behalf of our client Northwest Environmental Advocates (NWEA), received a favorable summary judgment decision this week in our Clean Water Act citizen suit against the City of Medford over the City’s nutrient pollution, which for years has contributed to adverse ecological effects in the Rogue River including the proliferation of nuisance algae and shifts in the native macroinvertebrate community. Medford’s pollution has long been observed by river users like the Rogue Fly Fishers, who first described the problem in a 2013 report by biologist Rick Hafele.

Earthrise Files Lawsuit Challenging Dams on Columbia and Snake Rivers

Earthrise Law Center filed an eighth supplemental complaint with the U.S. District Court for the District of Oregon over the federal hydropower systems in the Columbia and Snake Rivers and the agencies’ failure to comply with the ESA and NEPA.

An Indiana Federal District Court Court granted Earthrise’s motion and accepted our amicus curiae (“friend of the court”) brief, filed on behalf of National Parks Conservation Association, which urges the Court to reject a consent decree between the government and U.S. Steel until it was strengthened to account for past and future natural resource damages to the Park and contained a sufficient penalty to deter U.S. Steel from future Clean Water Act violations. In doing so, the judge stated allowing the brief would “provide a unique, helpful perspective for the Court to consider” when deciding whether or not to accept the decree.

On behalf of Northwest Environmental Advocates (NWEA), on May 16, 2018 Earthrise Law Center filed a lawsuit against the City of Medford, Oregon over its Clean Water Act violations that have caused harmful changes to the aquatic ecosystem in the Rogue River, a prized steelhead fishery in Southern Oregon.

Cormorants Disappear Amid Corps’ Culling Program

Professor and Earthrise attorney, Dan Rohlf, has been fighting against a controversial federal cormorant culling program under which federal agents could eventually kill as many as 11,000 adult double-crested cormorants and destroy even more nests in the estuary of the Columbia River as part of a plan to save native salmon. This summer thousands of cormorants have left the nesting grounds along the Columbia River.

Forest Service Withdraws Controversial Vegetation Clearance Project in California

In response to a lawsuit filed by Earthrise on behalf of the California Chaparral Institute and Los Padres ForestWatch, the U.S. Forest Service has withdrawn a harmful fuel break project that would have damaged fragile habitat and threatened rare species in Los Padres National Forest along California’s Central Coast.  On Monday, the conservation groups agreed to drop their pending legal action against the project, which they filed last December in U.S. District Court.

Earthrise filed a petition today on behalf of the Northwest Environmental Advocates (NWEA), the Northwest Environmental Defense Center (NEDC), and fish advocate, Bill Bakke, seeking to force Oregon’s Department of Environmental Quality (DEQ) to address the enormous backlog of administratively continued Clean Water Act permits, known as “Zombie Permits.”

Earthrise attorney Kevin Cassidy Receives Cape Cod Bay Life Preserver Award

Earthrise attorney Kevin Cassidy was awarded the Cape Cod Bay Life Preserver Award for 2016 by the Jones River Watershed Association (JRWA). JRWA Executive Director Pine duBois said Cassidy was being recognized for his work on the Pilgrim Nuclear Plant trial in August 2016, which challenged a permit from the Town of Plymouth, MA given to Entergy Corporation authorizing the long-term storage of spent nuclear fuel at the Pilgrim plant located on the shores of Cape Cod Bay.

Trump Instructs EPA to “Review and Rescind or Revise” Waters of the U.S. Rule

On February 28, 2017, President Trump signed an Executive Order (EO) instructing the EPA and Army Corps of Engineers (the “Agencies”) to begin a rulemaking to rescind or revise the Clean Water Rule, a 2015 regulation that defined the phrase “waters of the United States” (WOTUS) as used in the federal Clean Water Act (CWA), thereby identifying those waters protected by the Act’s restrictions on pollutant discharges.

Lawsuit Seeks New Toxic Standards for Washington State Waters

Today Earthrise filed a lawsuit on behalf of Oregon-based Northwest Environmental Advocates (NWEA) challenging EPA’s failure to respond to an 88-page petition submitted to the federal agency over three years ago, in October 2013. The petition seeks EPA’s action to update Washington’s water quality standards for toxics, primarily for the protection of aquatic life, such as salmon and steelhead.

Green River Trial Final Stages- Earthrise Seeks Cleanup

Last week, Earthrise brought the Green River in Illinois one step closer to being restored after decades of concrete dumping along its banks by an adjacent landowner and owner of a demolition and trucking company. In federal court in Rock Island, Illinois, on behalf of Quad Cities Waterkeeper and Prairie Rivers Network, Earthrise attorneys Kevin Cassidy and Lia Comerford presented evidence about the harm the unauthorized concrete dumping has caused to their clients and the Green River and urged federal judge Sara Darrow to order and oversee a comprehensive restoration plan.

Longtime partners, Northwest Environmental Advocates (NWEA), represented by Earthrise attorney Allison LaPlante and Seattle attorney Paul Kampmeier of Kampmeier & Knutsen filed a lawsuit today against the EPA and NOAA for their failure to force Washington State to control polluted runoff in the state’s coastal watersheds, including Puget Sound. The lawsuit aims to force the agencies to impose Congressionally-mandated funding cuts on the State of Washington for failing to comply with a law that requires the state to protect coastal water quality.

Walton Lake Win! Forest Service Withdraws Plans to Clearcut Ochoco

After obtaining a preliminary injunction to halt logging in the Ochoco National Forest that was scheduled to begin on October 17th, Earthrise is pleased to announce the Forest Service has withdrawn it decision authorizing the logging of hundreds of large and old growth Douglas-fir and Grand fir in the Walton Lake area of the Ochoco. This area is one of the most popular recreation sites in the Ochoco as well as a location of magnificent old growth and significant wildlife habitat.

Preliminary Injunction Win Stops Logging near Walton Lake this Fall

Earthrise attorney Tom Buchele and his co-counsel Earthrise alum Jesse Buss successfully argued a motion for a preliminary injunction in the Federal District Court in Portland on behalf of our longtime client League of Wilderness Defenders/Blue Mountains Biodiversity Project. The motion was necessary to prevent the Forest Service from logging hundreds of large Douglas and Grand fir, including quite a few enormous old growth fir trees, near Walton Lake in the Ochoco National Forest.

In a precedent setting case, United States District Judge Sara Darrow, of the Central District of Illinois, ruled on September 29 that maintenance of an otherwise unpermitted levee is not exempt from the federal Clean Water Act.

The extended Lewis & Clark community played key roles in the two biggest environmental cases of the Supreme Court’s fall term.  On December 3 and 4, 2012, the United States Supreme Court heard argument in two significant cases regarding stormwater pollution and the reach of the federal Clean Water Act.  In each case, LC law school faculty, students, and alumni were involved on various sides of the issues from gathering water samples, briefing the merits, writing amicus briefs and attending the oral arguments.
