Title: Unlawful Assassination or Lawful Targeted Killing: How Operation Vengeance Does (and Does Not) Shed Light on the bin Laden and al-Aulaki Strikes.

Description: In the past five months, the United States has carried out successful military missions to kill al Qaeda founder/leader Osama bin Laden and al Qaeda in Yemen member Anwar al-Aulaki, the former by Navy SEAL strike team, the latter by a missile-firing drone aircraft. Critics have decried these killings as “assassinations,” but in fact there is strong historical precedent for targeted killings of high-ranking enemy combatants. There are, however, limits to the World War II analogy, and the power to order targeted killing against non-state actors is not without problems in an area where the legal rules, domestic as well as international, are arguably behind the times.
