Fighting for a Victim’s Right to Restitution
November 26, 2012
This summer, NCVLI was contacted by an attorney whose victim-client’s professional abilities have been severely impacted by the gunshot injury resulting from the crime. For this reason, the attorney sought future lost wages and probable future medical care costs as part of restitution in the Arizona criminal case. The victim’s attorney requested and obtained an opportunity for additional briefing on this critical issue. NCVLI provided legal research in support of the attorney’s arguments as he fought for the victim’s right to receive a restitution award that equals the full amount of the economic loss that he suffered as a result of the defendant’s criminal conduct.
NCVLI is happy to report that the case resulted in a positive outcome — the court granted the victim’s attorney’s request and issued a restitution order that compensates the victim for past medical expenses, future medical expenses, and future lost wages!
