Admiralty

  • Typically offered every other year
Description: The course involves an analysis of the nature and scope of admiralty jurisdiction of federal and state courts. We will study substantive admiralty law in contexts such as personal injury and death of maritime workers, carriage of cargo in ocean and inland navigable waters and maritime liens. We also touch briefly on admiralty law concepts concerning salvage, maritime collision, maritime pollution, marine insurance and general average.

Admiralty cases often arise out of international shipping transactions which may pose such issues as choice of national law, enforceability of foreign forum clauses in bills of lading, and availability of U.S. admiralty law remedies to injured foreign seamen
