Sexual Assault Awareness Month has already seen a significant legal victory. NCVLI joined two amazing co-amici, the Domestic Violence Legal Empowerment and Appeals Project and theNetwork for Victim Recovery of D.C., in a case in which the perpetrator, who was the building manager, and the victim lived in the same complex. The perpetrator drugged and sexually assaulted the victim. A civil protective order was obtained that required the perpetrator to vacate his apartment, which the victim had to pass daily as she entered or left the building. The perpetrator appealed. The D.C. Court of Appeals affirmed the imposition of the protective order, including the perpetrator’s vacation of his apartment! The court determined that the law authorized the court to order a perpetrator to vacate his home where such relief is necessary to effectuate a stay-away order.
