But, explains Lewis & Clark Professor Tung Yin, even if the accused did set the fire, he might not be convicted of arson. “”The prosecution has to prove the defendant committed this act intentionally, that their goal was for the act to occur,” notes Yin. “If the jury decides, ‘No we don’t think the defendant acted intentionally, then they would acquit on the second-degree arson” charge, although the accused could still be found guilty of reckless burning, a lesser charge.
