Workers' Compensation

This course will provide an overview of (state) workers’ compensation laws in general, with an emphasis on the Oregon statute. We will cover the history and purpose of the workers’ compensation system, exclusivity of remedy, “subjectivity,” the concept of “arising out of and in the course of” employment, what constitutes a compensable injury and occupational disease, responsibility between employers, and other relevant statutes and case law. There will be a few guest speakers (current practitioners or judges). Grades will be based on a final short answer and essay examination, and class participation.
