    Professor Joseph Miller

Students are encouraged to take advantage of this wonderful networking opportunity!  It is a great way to meet local attorneys, talk with professors and have a great time.

Our very own Professor Joseph Miller will present on the topic of “Bilski v. Kappos: The More Things Change, the More They Stay the Same.”

In Bilski, the Supreme Court unanimously rejected the claims at issue for their failure to recite statutory subject matter under § 101. But the Court divided internally on the appropriate rationale for this conclusion.  Professor Miller will discuss the several opinions in the case, exploring how the Court’s internal disagreements about the best rationale for rejecting Bilski and Warsaw’s risk-hedging-strategy claims could play out at the Federal Circuit and the PTO.

Professor Joseph Miller
has taught Patent Law and other IP courses at Lewis & Clark Law School since the fall of 2002. After receiving his JD from Northwestern University in Chicago in 1994, Miller clerked for two years for Judge Michel. He practiced at Sidley & Austin from 1996 to 2000, and served in the USDOJ’s Antitrust Division from 2000 to 2001.
