2015-2016 International Law Distinguished Visitor Lecture: The Investor-State Arbitration Regime and European Union Law: On a Collision Course?

The International Law Program is proud to welcome the 2015-2016 International Law Distinguished Visitor, Professor George Bermann of Columbia Law School. Professor Bermann will speak to faculty, students, and the community on The Investor-State Arbitration Regime and European Union Law: On a Collision Course?

Professor Bermann will discuss tensions between European Union law and investment treaties concluded by individual EU countries, as highlighted by recent efforts by the European Commission to block the enforcement of arbitral awards issued in favor of foreign investors under those treaties in the United States and elsewhere.  The conflict between EU law and investor-State arbitration is most acute for States that participate in both regimes, but does not affect them alone, as third-countries such as the United States, are also called upon to navigate around them. American companies are making claims under investment treaties with increasing frequency, and debates over investor-State arbitration have taken on central importance in ongoing negotiations over the controversial Transatlantic Trade and Investment Partnership (TTIP) between the United States and the European Union.

Professor Bermann is one of the world’s leading experts in international arbitration and European Union law. Among his many activities, Professor Bermann is currently serving as the Chief Reporter for the American Law Institute’s Restatement (Third) of the US Law of International Commercial Arbitration, and as President of the Académie internationale de droit compare (International Academy of Comparative Law).  At Columbia, he directs the Center for International Commercial and Investment Arbitration and co-directs the European Legal Studies Center.  He concurrently serves as a permanent affiliated faculty member at both the Institut d’Études Politiques (Sciences Po) in Paris, France, and the Collège d’Europe in Bruges, Belgium.
