- Description: This course will introduce students to the federal Lanham Act and related statutory and common-law doctrines designed to protect against consumer confusion and appropriation of commercial goodwill. The course will cover trademarks, service marks, trade dress, unfair competition, and (time permitting) false advertising. For each of these subjects we will discuss the policy reasons for offering protection, eligibility requirements, the prima-facie cause of action, typical affirmative defenses, and remedies.

The American Bar Association accreditation standards require students to regularly attend the courses in which they are registered. Lewis & Clark expects students to attend classes regularly and to prepare for classes conscientiously. Specific attendance requirements may vary from course to course.
