Stay Current on Victims’ Rights Cases
A recent alert was on the case of People v. Brown, in which the Michigan Court of Appeals upheld a restitution order. Central to the case was whether a defendant could be held responsible in restitution for injuries caused by a co-defendant. Causation is a hot topic in restitution and this case definitely rose to the level of New & Noteworthy as the court stated, “Had [defendant] not taken part in an armed robbery and home invasion, the victim would not have been injured. Stated differently, while [defendant’s] conduct was not the cause of the victim’s injury, it was certainly a cause.” Visit our New & Noteworthy webpage to read the full summary as well as a link to the court’s opinion.
